Plaintiff Citizens of Humanity, LLC sued defendants Danemar, S.A. and its principals Marc and Daniela Elbaz for damages from an alleged breach of a foreign distribution agreement for jeans.
Danemar cross-complained for breach and for money had and received.
Contentions
PLAINTIFF'S CONTENTIONS:
Citizens of Humanity claimed that Danemar and the Elbazs were liable for failing to purchase minimum quantities of jeans under a written distribution agreement following Citizens of Humanity's termination of the agreement.
DEFENDANT'S CONTENTIONS:
Danemar and the Elbazs claimed that they were not liable to Citizens of Humanity. Defendants further contended that Citizens of Humanity owed them for jeans that they paid for but were never delivered.
Damages
Plaintiffs sought close to $800,000. Defendants, in their cross-claim, sought $30,000.
Result
The jury found that the Elbazs were not liable to Citizens of Humanity. The jury found that Danemar was liable to Citizens of Humanity in the sum of $47,680. The jury also found that Citizens of Humanity was liable to Danemar in the sum of $30,677. Thus, Citizens recovered from Danemar a net sum of $17,001.
