Scott Hays sued his former employer Coast Community College District and its Dean of the Literature and Language Division, Michael Mandelkern, following his termination as a part-time English instructor at the college.
Contentions
PLAINTIFF'S CONTENTIONS:
Hays contended that Mandelkern treated part-time teaching staff in a disparate manner when it came to allocating program funding, class assignments, and its own memorandum of understanding, policies and procedures. He claimed there was a causal connection between him engaging in protected activity and Mandelkern's decision not to renew his teaching contract. He brought claims for defamation, blacklisting under Labor Code Sections 1050 and 1054, and retaliation under Labor Code Section 1102.5.
DEFENDANTS' CONTENTIONS:
Defendants contended that Hays' claims were barred by the one-year statute of limitations.
Result
The court granted defendants' motion for summary judgment, finding all three of Hays' claims time barred.
