Facts
On Nov. 26, 1995 at approximately 12 noon, at the intersection of Eucalyptus and Whitehill in the City of Moreno Valley, claimant Song Cha Thibodeau, a 39-year-old housewife, and her husband, were traveling uphill on eastbound Eucalyptus. Claimant was a passenger in the front right seat. An uninsured motorist was traveling northbound on Whitehill. The uninsured motorist ran the stop sign and was struck by the Thibodeaus. Claimant's husband did not observe the uninsured motorist until the uninsured vehicle was 10 feet in front of claimant's vehicle. He slammed on his brakes but could not avoid a collision. The police estimated that claimant's husband skidded 12 feet until impact. The uninsured motorist fled the scene and claimant filed this claim with her own insurance company.
