Facts

On Aug. 29, 2003, 12-year-old plaintiff Ashlea Biggs was a passenger in the back seat of a vehicle driven by defendant Corey Rusick on the I-40 freeway. While driving, Rusick lost control of the vehicle, causing it to roll over. Biggs was thrown from the car, and sustained serious injuries. She sued Rusick.

Contentions

PLAINTIFF'S CONTENTIONS:
Plaintiff alleged that defendant fell asleep at the wheel.

DEFENDANT'S CONTENTIONS:
Defendant alleged that a truck hit them, which caused the accident.

Damages

Plaintiff sought $37,149.22 in medical costs.

Injuries

Plaintiff suffered a closed head injury, acute head injury, and a broken ankle.

Result

Judgment was entered against defendant for $115,000.
