Richard Amaya was driving west on Ashlan Avenue in Fresno on June 13, 2009 when he collided with the passenger side of a vehicle operated by Adel Zamzami at the intersection with Hayes Avenue.
Contentions
PLAINTIFF'S CONTENTIONS:
Amaya filed suit against Zamzami, alleging motor vehicle negligence. Amaya contended that Zamzami failed to yield to oncoming traffic while attempting to make a left turn, causing the collision.
DEFENDANT'S CONTENTIONS:
Zamzami conceded liability, but contended that Amaya did not sustain any serious injury from the accident.
Damages
Amaya sought $760 in damages for past lost earnings, $9,225.20 in past medical costs, as well as $23,000 for future medical costs and pain and suffering damages.
