Ron Adelman and his mother, Dolores Adelman, entered into an option agreement dated June 26, 2006, in which Ron Adelman had an option for 10 years to purchase a property in Calabasas for $400,000. Before Dolores Adelman had passed away, she transferred the property into the Dolores Adelman Separate Property Trust. Dolores' husband, Jerome Adelman, became a successor Trustee of the Dolores Adelman Separate Property Trust. Jerome Adelman as Trustee refused to sell plaintiff the property after plaintiff exercised his option.
Contentions
PLAINTIFF'S CONTENTIONS:
Plaintiff claimed that he had an option to purchase property from the Dolores Adelman Separate Property Trust. Defendant, plaintiff's father, refused to abide by the terms of the option agreement and therefore, should be liable for damages for breach of contract.
DEFENDANT'S CONTENTIONS:
Defendant argued that he did not enter into, nor did he execute, the option agreement.
Result
Plaintiff's verdict for $540,000.
