Facts

Trent Veasey sued San Diego Police Officers Christopher Hays and William Landsdowne as well as the San Diego Police Dept. and the City of San Diego, in connection with an incident that allegedly occurred in December 2014.

Contentions

PLAINTIFF'S CONTENTIONS:
Officer Hays allegedly targeted plaintiff, a transgender woman, and forced plaintiff to orally copulate him under threat of arrest.

Plaintiff asserted causes of action for battery, false imprisonment, violation of Civil Code Section 51.7, violation of Section 51.9, violation of Section 52.1, violation of Section 52.4, violation of civil rights under Section 1983, violation of civil rights under Monell, and intentional infliction of emotional distress.

DEFENDANTS' CONTENTIONS:
The city moved to dismiss some of plaintiff's third, fourth, fifth, seventh, and ninth causes of action, due to the lack of a professional relationship between the officer and plaintiff and for being duplicative and cumulative. Defendants also contended that plaintiff's allegations were cumulative and conclusory. Further, the city denied any vicarious liability for the officer's alleged conduct.

Result

San Diego agreed to settle for $160,000.
