Facts

Azniv Ohanian sued David Rose in connection with a collision between a motor vehicle and a pedestrian that allegedly occurred on March 13, 2013.

Contentions

PLAINTIFF'S CONTENTIONS:
Plaintiff, who was 71 at the time, was walking along a crosswalk in Glendale when she was struck by a vehicle operated by defendant as defendant was making a right turn. Plaintiff sustained injuries as a result and sued defendant for negligence. Defendant allegedly failed to yield the right of way to plaintiff, a pedestrian, and failed to maintain a proper lookout.

DEFENDANT'S CONTENTIONS:
Defendant contended he stopped at a light and looked both ways before proceeding. Defendant also disputed plaintiffs' claimed injuries, claiming they were unrelated to the subject incident.

Injuries

Ohanian sustained a fracture in her spine, aggravating her spinal issues. She also sustained a hematoma to her head and a traumatic brain injury. She also suffered from a compressed nerve on her left side. She treated her ailments with epidural steroid injections and trigger point injections. She later underwent a procedure known as a kyphoplasty procedure. Despite treatment, she continued to experience pain and discomfort. Moreover, the range of motion on her back had been limited as a result of the crash.

Result

The parties ultimately reached a $300,000 settlement.
