Facts

Plaintiff sued defendants for negligence and negligence per se relating to three separate automobile collisions. The first one occurred on April 26, 2016 when plaintiff's vehicle was rear-ended by a vehicle operated by John Pinney as plaintiff was stopped in traffic. The second collision occurred on Aug. 22, 2013 when plaintiff's vehicle was again rear-ended, this time by a vehicle driven by James Westover as plaintiff was stopped at a red light. The third collision occurred on Jan. 15, 2014 when plaintiff's vehicle was involved in a collision with a vehicle driven by Steve Lum, who made left turn in front of plaintiff.

Contentions

PLAINTIFF'S CONTENTIONS:
Plaintiff contended that defendants negligently operated their vehicles and that the owner of Pinney's vehicle, Richard Clements, and Pinney's employer, International Solutions Network, Consulting Company LLC, were vicariously liable for Pinney's actions.

DEFENDANTS' CONTENTIONS:
All the defendants admitted liability except Lum. Defendants contested plaintiff's injuries, arguing that she had been involved in three other motor vehicle accidents in the five years before the accidents at issue.

Injuries

Plaintiff claimed the three collisions caused indivisible injuries to her neck and shoulders.

Result

Plaintiff settled with Pinney and Clements for $150,000, with Lum for $92,500, and Westover for $33,500, for a total recovery of $276,000.
