PLAINTIFF'S CONTENTIONS:
Plaintiff attended a bingo event that was open to the public and hosted by defendant Booster Club. The event was held at the school premises. Plaintiff allegedly fell at the school parking lot due to inadequate lighting and maintenance of the parking lot, constituting a dangerous condition. Plaintiff sued defendants for negligence – premises liability.
DEFENDANTS' CONTENTIONS:
Defendants denied the allegations and asserted various affirmative defenses.
Result
The parties reached a $38,000 settlement, of which the School District was to pay $33,000 and the remaining by the Booster Club.
