A sprinkler system at a retail space burst damaging fabrics and garments owned by respondent Je Suis Inc. dba Kevin Corp. Je Suis filed a claim with its insurance company, petitioner Covington Specialty Insurance Co.
Contentions
PETITIONER/OPPOSING PARTY'S CONTENTIONS:
Covington contended that all policy benefits due to the Insured had been paid and the Insured failed to substantiate the amounts being demanded by the Insured.
RESPONDENT/MOVING PARTY'S CONTENTIONS:
Je Suis claimed that all the fabrics and garments were a total loss, and claimed policy limit of $2 million. Plaintiff paid $205,000 as the undisputed amount.
Result
The Arbitrator found in favor of Je Suis and awarded $1,482,000.
Other Information
Covington paid the arbitration award, but withheld $88,000 as representing garments the parties agreed were not damaged. Je Suis sought to confirm the arbitration award for the full amount. However, the court held that this dispute would have to be settled by lawsuit. FILING DATE: May 13, 2016.
