PLAINTIFF'S CONTENTIONS:
Defendant allegedly caused the collision and his resulting injuries.
DEFENDANT'S CONTENTIONS:
Defendant demurred, challenging the sufficiency of plaintiff's allegations. Defendant contended that plaintiff failed to state a claim for relief and that the action was barred by the applicable statute of limitations. Plaintiff allegedly filed this claim beyond the time allotted to file after defendant's rejection of plaintiff's claim. Because plaintiff failed to file a timely claim, his complaint was therefore time-barred.
Result
The court sustained LACMTA's demurrer without leave to amend.
