Facts

Ruby Satterwhite sued Dean Nielsen and KC Refrigeration, in connection with a motor vehicle collision that allegedly occurred on Feb. 25, 2015 along Sepulveda Blvd. in Los Angeles.

Contentions

PLAINTIFF'S CONTENTIONS:
Defendant Nielsen allegedly broadsided plaintiff's compact car with his van as plaintiff entered the intersection. Defendant was allegedly travelling on the direction opposite of plaintiff's and was attempting to make a left turn when he collided with plaintiff's vehicle. Plaintiff was injured and sued defendant for negligence and vicarious liability. Plaintiff blamed the collision on defendant for making an improper turn. Plaintiff maintained she had the right-of-way.

DEFENDANTS' CONTENTIONS:
Defendants blamed the incident on plaintiff, alleging that she failed to yield to defendant Nielsen as what the other motorists had done, to allow Nielsen to complete his turn.

Damages

Satterwhite sought $270,000 in past medical expenses and an unspecified amount in past and future pain and suffering damages.

Injuries

Satterwhite injured her back and neck. She underwent chiropractic manipulation. She later underwent discectomy and treated with physical therapy. Despite treatment, she continued to experience discomfort. Moreover, she had a limited range of motion.

Result

The parties reached a $720,000 mediated settlement.
