Laurie Lindsey sued Costco Wholesale Corp., involving allegations of workplace discrimination.
Contentions
PLAINTIFF'S CONTENTIONS:
Plaintiff, who was a lesbian, was a cashier for defendant. Her supervisor allegedly began harassing her in August 2014 about her gender and sexual orientation. Plaintiff claimed her supervisor slammed into her, resulting in a wrist injury. Plaintiff sought to be transferred to a different location. Later, a different supervisor physically harassed her. Further, plaintiff claimed that she was stressed from trying to avoid her supervisor.
In June 2015, plaintiff requested for medical leave of absence due to the mental toll it had taken on her. Defendant approved extension of her leave until Jan. 1, 2016, but that she was forced to resign on Dec. 16, 2015. Thereafter, plaintiff sued defendant for harassment, failure to prevent harassment, and negligent hiring, supervision, and retention. Plaintiff claimed that her supervisor had been previously disciplined because of his conduct against her.
DEFENDANT'S CONTENTIONS:
Defendant denied plaintiff's allegations and claimed that no one corroborated plaintiff's claims.
Injuries
Lindsey suffered from emotional distress and a wrist injury.
Result
The jury found in favor of Costco.
