PLAINTIFF'S CONTENTIONS:
Defendant allegedly posted a photo of her during its "El Bueno, El Malo, y El Feo" morning radio show without her consent. The photo allegedly placed defendant in a false light because it could be viewed in a provocative fashion, damaging her reputation.
DEFENDANT'S CONTENTIONS:
Defendant claimed plaintiff's photo was posted as part of a parody, defeating her defamation claim.
Damages
Marroquin sought more than $7 million in damages plus punitive damages, totaling about $77 million.
Result
The jury found in Marroquin's favor and determined she was damaged in the amount of $72,025. The jury, however, declined to award punitive damages.
