Facts

On March 17, 1996, Michael O. Sullivan sat in the front seat passenger of his friend's vehicle. They were traveling west on La Veta Pass, Highway 160, in Costilla County when Roger Mann Jr.'s vehicle struck the rear of their vehicle.

Settlement Discussions

There was a $100,000 policy limits demand preceded by a $95,000 statutory offer of settlement. There was a final $50,000 statutory offer of settlement prior to trial.

Injuries

The plaintiff alleged soft tissue injury to the neck, L2, 3, 4 disc fissures and high intensity zones and permanent headaches. Permanent impairment ot the lumbar spine. Pain and suffering and loss of enjoyment of life. The PIP carrier paid $49,000 in medical and rehabilitation expenses and $20,800 in lost wages. Past and future economic losses of $384,000.
