Robert Mayo, a 51-year-old tourist from Maine, was riding on the outside standing platform of a cable car that was rolling on Powell Street in San Francisco on Jan. 31, 2003. Richard Bundy, a tourist from New Jersey, was driving an Enterprise Rent-A-Car when he tried to make a left turn onto Bush Street from Powell Street. The car he was driving struck the side of the cable car and contacted Mayo's left foot. Mayo sued Bundy and Enterprise-Rent-A-Car Company of San Francisco, alleging vehicular negligence and vicarious liability. The defendants neither admitted nor disputed liability. They did dispute the nature and extent of Mayo's injuries, however.

Injuries
Mayo alleged that the contact crushed the inside of his left ankle, causing him considerable and ongoing pain. The foot and ankle specialist discovered six months after the accident that Mayo had suffered an injury to his posterior tibial tendon that would require at least a tendon debridement and possible tendon transfer in the future.
