Facts
Plaintiff U.S. Equal Employment Opportunity Commission (EEOC) claimed defendant Vista Unified School District (VUSD) did not hire Wendy Santamaria, 51, based on her age. The french teacher position, the EEOC claimed, went to a less-qualified, approximately 30-year-old applicant instead of Santamaria.
Result
The case was settled and VUSD agreed to pay $5,000 to benefit students within the district by providing a college scholarship to students at Vista High School who scored 3 or higher on the AP French exam for the 2009-2010 school year. In the event that more than one student scored accordingly, the scholarship would be split evenly among those qualified students. Further, if no student scored 3 or higher during the 2009-2010 year, the money would be held for those who met the requirement in the 2010-2011 year. If no Vista High student met the requirement in that year, the scholarship was to be transferred to students who scored 3 or higher at Rancho Bueno Vista High School. Provided that no Rancho Bueno Vista student qualified either, the funds would be spent to benefit French students at Vista High School during the 2011-2012 school year. VUSD also agreed to implement policies and procedures to prevent discrimination and retaliation and provide training and record-keeping.
