Facts

Plaintiff, the Andrew Meieran Family Trust (Trust), owned the Edison. Developer Barry Shy and two entities that Shy controlled entered into an agreement with Meieran to buy the Trust's interest in residential units in the Higgins Building. However, the Trust brought an action against Shy and the entities for breach of contract.

Result

The arbitrator granted the trust several commercial spaces in the building, and $8,499,299 in compensatory damages, interest, and attorney fees. Subsequent to arbitration, the Los Angeles Superior Court affirmed the award in its entirety and awarded the trust $158,388 in additional interest. The court also granted attorney fees and costs amounting to $171,000. Thus, the total award was $8,828,688.
