Facts

Banning Ranch Conservancy filed a petition for writ of mandate against the City of Newport Beach, challenging the City's plans to develop Sunset Ridge Park on a property next to West Coast Highway and Superior Avenue. The petitioner alleged that the environmental impact report prepared for the park's development was inadequate; in particular, Banning Ranch opposed development on a road to the park from West Coast Highway over the neighboring parcel, the Newport Banning Ranch.

Result

The trial court denied the petition, ruling in favor of Newport Beach and allowing the City to move ahead with development of the park.
