Facts

Decedent, Alice Ho, 64, was a pedestrian walking within a marked crosswalk when struck by defendant Grossman. Ho died from her injuries approximately two days later.

Plaintiffs Chau Lu and Chong Ho, the decedent's brothers, brought this wrongful death action against Grossman.

Contentions

PLAINTIFF'S CONTENTIONS:
Ho claimed that the defendant was negligent in operating his vehicle by failing to observe and yield to decedent.

DEFENDANT'S CONTENTIONS:
Grossman did not contest liability.
