Liudmila Yuryeva entered into four agreements with Academy of Couture Art LLC, Sonia Ete, and Thierry Ete in October 2008 and January 2009. Under the agreements, Yuryeva agreed to pay the Academy and the Etes $160,504 for fashion design courses. Yuryeva subsequently paid $18,108 for tuition.
Contentions
PLAINTIFF'S CONTENTIONS:
Yuryeva filed suit against the Academy and the Etes, alleging that they used her tuition money for a Paris trip to visit the Etes' family, under the guise of study. She further contended that while on the trip, Yuryeva was subjected to unwanted advances from Theirry and his brother. Yuryeva alleged that the defendants breached the agreement by failing to provide professional, scholastically accredited and credible fashion design and related courses, as promised. She claimed breach of contract, negligent misrepresentation, fraud, rescission, intentional infliction of emotional distress, and slander.
Result
The jury awarded Yuryeva $6,633 in damages for negligent misrepresentation.
