Facts
The plaintiff was a passenger in her friend Adi Greenberg's vehicle. The vehicle was identified to a Los Angeles Police Officer by a crime victim as belonging to an attempted murder and kidnapping suspect. As a result, several police officers stopped the vehicle to investigate, detaining all of the occupants. Officer Alcocer responded to the officers' backup request and was asked to conduct a patdown search of the female plaintiff because Alcocer was a female officer.
Contentions
PLAINTIFF'S CONTENTIONS:
Plaintiff alleged she was held in two sets of handcuffs longer than anyone else detained by officer Stefanie Alcocer. She contended that Alcocer inappropriately groped and molested her. Plaintiff filed suit against the City of Los Angeles, the City of Santa Monica, Santa Monica Police Dept., Los Angeles Police Dept., and Alcocer, constitutional violations, supervisorial responsibility, assault, battery, and negligence.
DEFENDANTS' CONTENTIONS:
Defendants contended that the patdown search was conducted in a manner that was reasonable, appropriate, and consistent with the interests of officer safety and the policies of the Los Angeles Police Department.
Injuries
Plaintiff claimed she was sexually assaulted.
Result
The jury rendered a verdict for the defense.
