Nelson Estival worked as a museum guard for the City and County of San Francisco and The Asian Art Museum from March 2004 until Aug. 31, 2007. Estival, who worked on a provisional basis, was rejected for a permanent position on Aug. 30.

Contentions

PLAINTIFF'S CONTENTIONS:
Estival filed suit against the City and the Museum, alleging he was rejected for the permanent position in retaliation for his complaining about wage and hour violations.

Injuries

Estival claimed to suffer emotional distress.

Result

The parties reached a settlement for $57,000.
