Beginning in 1987, plaintiff Chad Mishra, a 51-year-old native of India, worked as a hospital safety officer at defendant Harborview Medical Center. The plaintiff was laid off and successfully sued for reinstatement and damages in 1989. The case was settled in 1992 for cash payment and reinstatement. The defendants contended that by 1993, the plaintiff was performing poorly on the job. The plaintiff contended he was denied promotions and pay raises, and eventually was suspended without pay for one week.
