On Aug. 25, 1993, plaintiff Floy Jones, a 63-year-old woman, was injured while riding to the mall with defendant Catholic Community Service's worker Rhonda Ruff. Ruff's Geo Metro was rear-ended by a Mazda Miata, allegedly resulting in injury to the plaintiff. The plaintiff brought this action against the defendants based on negligence. For over 50 years, the plaintiff had suffered from arthritis. She had all of her toes replaced with implants and was living on her Social Security Disability pension. The defendant claimed no liability based on the plaintiff's previous condition.
Settlement Discussions
The plaintiff made a settlement demand for $100,000, increased to $135,000. The defendants made no settlement.
Injuries
The plaintiff suffered from carpal tunnel syndrome in the right wrist requiring corrective surgery in April 1994; and impingement syndrome in her right shoulder, requiring a surgery in October 1994 and again in 1997.
Other Information
The verdict was reached approximately two years and one month after the case was filed. The court's decision was based on the plaintiff's failure to prove that she was injured in the collision. ARBITRATION: An arbitration was held on Feb. 19, 1997, before Ronald Roberts, of the Pierce County Superior Court Arbitration Panel, resulting in a finding of liability but no damages. The plaintiff requested a trial de novo.
