Facts
On Sept. 6, 1996, plaintiff Kevin Scott, was stopped for traffic. The plaintiff contended defendant Michael Sailing failed to yield the right-of-way and attempted to cross traffic behind the plaintiff. Defendant Sailing was struck broadside by defendant Jerrod Roselieb's vehicle which pushed both vehicles into the plaintiff's vehicle. The plaintiff brought this action against the individual defendants based on negligence and against Allstate on a UIM claim. Defendant Roselieb was uninsured.
Settlement Discussions
The plaintiff made a settlement demand for $15,000. Defendant made an offer of $5,000. No offer from defendant Sailing. Defendant Allstate was dismissed because defendant Sailing had adequate insurance to pay the judgment.
