Facts
On Aug. 15, 1995, plaintiff William Burney, a 44-year-old laborer, had a disagreement with defendant Susan Watson, his live-in girlfriend. The defendant left the house and got in her small pick-up truck. The plaintiff jumped in the pick-up bed when defendant would not let him in the cab. The defendant contended that she drove about seven blocks, stopping twice to let the plaintiff get out and walk home, but he refused. The defendant drove onto the main road at the 50 mph speed limit and stopped two more times. After the second stop on the main road, as the defendant pulled away and sped up to 30 mph, the plaintiff stood up and either fell or jumped from the truck. His blood alcohol at the hospital was 0.23. The plaintiff brought this action against the defendant based on negligence.
