Claimants brought an action against Respondents, asserting claims for breach of contract, fraud, breach of fiduciary duty, elder abuse, failure to treat Claimants in a just and equitable manner, negligence, negligent misrepresentations and omissions, violations of California's Corporate Code, control person liability, and unsuitable recommendations. The claims related to investments in various Direct Participation Programs.

Damages

Claimants sought damages in the amount of $164,909, as well as attorney's fees and punitive damages.

Result

The claims were found to be false and the requested relief was denied. The panel recommend that respondents John Evan Schooler, Curtis Jerome Sathre III, and Warren Rees Horney be expunged from all references and records to the arbitration matter.
