PLAINTIFF'S CONTENTIONS:
Plaintiff alleged that he was the middle car in a chain of multiple-vehicle rear-ender accidents and chipped his tooth in the process. He sued defendant George Emanuel, the driver of the car driving behind plaintiff. Plaintiff claimed that he came to a stop, but defendant did not, causing the collision and pushing plaintiff into the traffic in front of him. Plaintiff contended that defendant was negligent in the operation of his vehicle.
Settlement Discussions
Arreola demanded $25,000 in settlement. Emanuel offered $6,626 in settlement.
Damages
Arreola requested $3,356 in past medical expenses, $300 in past lost wages, and an unspecified amount for pain and suffering damages.
Injuries
Arreola claimed he fractured his tooth, hurt his gums, and sustained soft-tissue injuries to other parts of his body, including his left elbow, back, and neck. He ultimately had to remove his tooth, which had died as a result of the injury.
Result
The parties agreed to settle the dispute for $17,500.
