Facts

Monique M. Morrison sued Courtney S. Falsey relating to an automobile collision.

Contentions

PLAINTIFF'S CONTENTIONS:
Monique Morrison, 30, claimed that her vehicle was struck on the driver's front corner by a vehicle operated by defendant, who entered the intersection without failing to yield the right of way. Morrison sued Falsey for negligently operating her vehicle.

DEFENDANT'S CONTENTIONS:
Falsey claimed that her view of the intersection was obstructed by a large truck and that she struck Morrison's vehicle as she was inching forward.

Settlement Discussions

Morrison made a $300,000 demand and the defense made a CCP Section 998 offer of $25,000.

Damages

Morrison sought damages for her medical expenses, loss of future earning capacity as a massage therapist, and past and future pain and suffering.

Injuries

Morrison claimed injuries to her head, alleging she hit her head on the driver's side windshield during the collision. She complained of headaches and neck pain. She also claimed a cervical facet syndrome and closed head injury. Additional claimed injuries included temporomandibular joint pain a few months after the accident.

Result

The jury returned a defense verdict, finding that Falsey was negligent but that her negligence was not a substantial factor in causing Morrison's injuries.
