Deborah Nevarez sued Dawn Davenport after she was struck by Nevarez's vehicle.

Contentions

PLAINTIFF'S CONTENTIONS:
Deborah Nevarez, 52, sued Dawn Davenport for negligence, contending Davenport injured Nevarez with her vehicle as Nevarez was walking across South Stewart Street in Sonora.

DEFENDANT'S CONTENTIONS:
Davenport contended that Nevarez was negligent for failing to look for vehicles before she crossed the street.

Injuries

Nevarez's claimed injuries included a concussion, broken arm, and fractured pelvis.

Result

The jury awarded plaintiff $200,000 in non-economic damages, reduced to $120,000 after attributing 40 percent contributory negligence to plaintiff. The court granted non-suit as to negligent entrustment causes of action, and granted a directed verdict as to all economic damages including wage loss and medical costs.
