Facts

Irene Corson and Susan Yacks filed a class action against Toyota Motor Sales, USA Inc. and Toyota Motor Corp. in connection with alleged defects in the electric power steering (EPS) in certain Toyota vehicles.

Contentions

PLAINTIFFS' CONTENTIONS:
Plaintiffs alleged that 2009 and 2010 Toyota Corolla vehicles had a defective EPS system that "causes the Vehicles to wander or drift from center at highway speeds and/or suddenly veer to one direction during normal use." Plaintiffs alleged that the defect created a safety risk that was not reasonable.

DEFENDANT'S CONTENTIONS:
Toyota denied any defect. Toyota contended that there might be other reasons to explain the phenomena of which plaintiffs complained.

Result

The parties reached a settlement, under which, Toyota agreed to install a re-tuned electronic control unit designed to address plaintiffs' complaint. Toyota also agreed to reimburse the cost to install the re-tuned ECU up to $695 and to implement a straightforward claims process.
