Plaintiffs Keith Pride and Lorreta Morgan lived in defendant Eunice Booker's building at 591-93 Waller from March 1994 through August 1995. The plaintiffs claimed they were forced to move because of harassment by the defendant. The plaintiffs alleged that the defendant intended to cause them to vacate the premises by performing the following actions: entering frequently without notice, removing personal property, tearing down an interior wall in the unit, turning off the electricity and heat, discontinuing utilities and assaulting plaintiff Morgan's daughter. The defendant contended that the plaintiffs originally promised to occupy the premises for only three months, then refused to vacate for more than 18 months, and that on May 7, 1995, they threw dirty water on her. The plaintiffs brought this action against the defendant based on a wrongful eviction theory of recovery. The defendant filed cross-complaint for battery and intentional infliction of emotional distress.
