On Aug. 22, 2003, plaintiffs David and Deborah Houdeshell, entered into a construction contract with defendant Premier Pools & Spas for the construction of a swimming pool at their property in Rancho Murieta. Premier acted as the primary contractor for construction of the pool, and Premier then subcontracted out different portions of the design, installation, material, construction, and inspection of the pool to various subcontractors, including defendants Air Blown Concrete and Rodriguez Brothers Pool Plastering Inc.
Contentions
PLAINTIFFS' CONTENTIONS:
Plaintiffs contended that defendants failed to perform the design, installation, management, and construction of the swimming pool and related facilities, in a workmanlike manner, causing plaintiffs' injury. Amongst other injuries, plaintiffs were left with a structurally unsound pool by defendants.
DEFENDANTS' CONTENTIONS:
Defendants denied any and all liability in this matter.
Damages
Plaintiffs claimed compensatory damages for the cost to repair defective construction.
Result
The case settled for $67,500.
