Defendant's school bus pulled out from a stop sign on Pierson Boulevard, at State Route 62, in Desert Hot Springs. Plaintiff's car hit the bus.
Contentions
PLAINTIFF'S CONTENTIONS:
Plaintiff contended that as a result of the accident she sustained mild TBI, cervical and lumbar bulging discs, headache, hearing loss, loosened teeth, bilateral carpal tunnel, right and left knee injuries, and trimalleolar fracture of the right ankle.
DEFENDANT'S CONTENTIONS:
Defendant claimed that plaintiff did not suffer TBI and that plaintiff's left knee surgery was unrelated to the incident. Defendant also claimed that plaintiff's neck and back injuries were pre-existing degenerative conditions, and that plaintiff had no carpal tunnel syndrome.
Settlement Discussions
Plaintiff demanded $900,000. Defendants offered $375,000. Defense argued case value of $200,000 to jury. Plaintiff argued case value of $1,100,000.
