Facts
On Aug. 31, 2006, at 7:25 a.m., at the intersection of Santa Anita Avenue and Valley Mall, in the city of El Monte, plaintiff was involved in a motor vehicle accident with defendant Lindsey Lesher. Defendant Lindsey Lesher was operating a vehicle owned by defendant James Lesher. Defendant Lindsey Lesher ran a red light, resulting in plaintiff James Dale's vehicle broadsiding defendant's vehicle. Both vehicles were declared a total loss.
Contentions
PLAINTIFF'S CONTENTIONS:
Plaintiff contended that he loss considerable sight in his right eye as a result of the accident. Plaintiff sustained a detached retina in his right eye, which required a retinal reattachment surgery. Following the reattachment surgery, plaintiff developed a cataract in his right eye, which required him to undergo cataract surgery. Plaintiff still has a permanent loss of vision in his right eye.
DEFENDANTS' CONTENTIONS:
Defendants did not dispute liability. Defendants did contend, however, that plaintiff did not seek timely medical care, which contributed to his vision loss.
Injuries
The plaintiff suffered retinal detachment of the right eye, which was corrected through surgery.
Result
The case settled for $250,000.
