Facts

In 2006, the Orange County Board of Supervisors agreed to a resolution that would split active and retired employees for determination of health insurance rates and benefits, which established higher premiums for certain of its retired employees.

The Retried Employees Association of Orange County filed a federal suit against Orange County, alleging that the county had breached its agreement to subsidize the health insurance rates for retired employees via a "pooling arrangement."

Result

Defendant won summary judgment as to all of plaintiff's claims. The judge found that defendant did not promise retired employees that the county would "pool" them with active employees for purposes of rate setting for their lifetimes, and that it was improper to imply such an obligation.

Other Information

Plaintiff will appeal.
