Facts

Tacori Enterprises filed an infringement lawsuit against Trice Jewelers Inc., in connection with the sale of allegedly infringing rings.

Contentions

PLAINTIFF'S CONTENTIONS:
Glendale-based Tacori designs, manufactures, and sells jewelry. Tacori accused Trice of selling non-Tacori rings under the Tacori name.

Tacori asserted causes of action for infringement of its trade dresses and copyrights.

DEFENDANT'S CONTENTIONS:
Trice claimed that it was an authorized dealer of Tacori Jewelry that did business in Colorado only. As such, it moved to dismiss the complaint for lack of personal jurisdiction.

Result

The court determined that it had no basis for asserting personal jurisdiction over Trice, and granted Trice's motion to dismiss.
