Facts

Wayne Kendrix filed a lawsuit against State of California Department of Development Services, Lanterman Development Center, Ibrahim Aly and Cheryl Bright in relation to his employment. Bright was dismissed later.

Contentions

PLAINTIFF'S CONTENTIONS:
Plaintiff worked as a supervisor as Lanterman in the Dept. of Developmental Services and Aly was his supervisor. He claimed that Aly kept trying to convert plaintiff to Islam after the terrorist attacks of September 11th and wanted him to work on Christmas. Plaintiff argued that these acts amounted to harassment due to his religion and that the department engaged in discrimination by letting this activity occur.

DEFENDANT'S CONTENTIONS:
Defendants argued that Kendrix did not ever complain about Aly, although they worked together for 10 years, and that Aly supervised several departments, making it impossible for him to have harassed plaintiff. Defendant argued that the claims occurred because Aly rehired a person who plaintiff did not like.

Settlement Discussions

Plaintiff demanded $295,000 and the defense offered $30,001 under CCP Section 998.

Damages

Plaintiff requested $150,000 for pain and suffering.

Injuries

Plaintiff claimed emotional distress.

Result

The jury found in favor of defendants.
