Facts

Plaintiff Margaret Hahn owned property in La Jolla. The pipes near her property broke, causing a free flow of water downslope, and damaging her property. Her house was "red tagged". Hahn filed suit against the city of San Diego for trespass.

Contentions

PLAINTIFF'S CONTENTIONS:
Hahn claimed that the city allowed its pipes to become corroded and blocked and to completely break. She further claimed that the repair was not entirely successful as her property continued to have slippage problems. Hahn claimed that her backyard hillside was damaged and that she continued to have seepage problems within her foundation.

Result

The parties settled.
