Ice Cream Distributors of Evansville, Indiana (ICD) brought suit against Dryer's Grand Ice Cream claiming violation of racketeering and antitrust laws for requiring ICD to agree to only distribute Dreyer's products to convenience stores.
Contentions
PLAINTIFF'S CONTENTIONS:
Plaintiff contended that Dreyer's violated the RICO Act, the Sherman Antitrust Act, and various state laws by requiring ICD to exclusively distribute Dreyer's products.
Result
The court dismissed the claims, finding that Dreyer's was within its legal rights to determine the manner in which its products are to be distributed.
