Plaintiff Janet K. Smith, a 50-year-old administrative assistant, and her boss, defendant Shawn Schultz, went to the defendant's home so that the plaintiff could retrieve some personal items. The defendant was driving the plaintiff back to her home when the plaintiff told the defendant to stop the car because she needed to retrieve her garage door opener. The plaintiff got out of the car and walked into the path of an oncoming vehicle. The plaintiff sued the driver of that vehicle, Lawrence Carl Snelly, who settled for his policy limits and then declared bankruptcy. The plaintiff then brought suit against her employer.

Injuries

The plaintiff sustained a comminuted fracture to her left leg, had damages in excess of $18,000, and alleged the need for further surgery.
