Facts
On July 28, 2010, Cristian Silva was driving on the 405 South Freeway in Los Angeles when a vehicle driven by Chris Herrington rear-ended Silva's vehicle. Silva filed suit against Herrington, who was also doing business as Full Spectrum.
Contentions
PLAINTIFF'S CONTENTIONS:
Plaintiff alleged that he hit his head on the windshield and his face on the car radio due to the impact of the crash. He claimed Herrington was negligent in driving his car, and that he should have followed the speed limit and kept an appropriate amount of distance his car and other vehicles.
Damages
Silva sought $8,000 in past medical costs, $300,000 in future medical costs, $1 million for future loss of earning capacity, $20,000 for academic decline, and $300,000 for emotional distress.
Injuries
Plaintiff suffered back, neck, head, and traumatic brain injury, as well as seizure.
Result
The parties reached a settlement amounting to $3,341.
