Facts

Plaintiffs Richard and Patricia Rodriguez and their minor children claimed the apartment they rented from defendants Andrew and Danuta Nizynki, was inhabitable because of water leaks that had caused mold grown and water damages. The plaintiffs alleged that they lost use of the apartment and suffered personal injuries and property damage.

The plaintiffs suffered from mold-related injuries.

The plaintiffs received a total of $175,000. Plaintiffs Ricky Rodriguez and Sabrina Rodriguez each received $50,625 which included $10,125 for attorney fees and $10,500 for expenses. The defendants agreed to pay $175,000 to settle plaintiffs' claims.
