Facts
Defendant International Thunderbird Gaming Corp. owned and operated casinos around the world. It approached plaintiff Michael Brannon about buying out his interest in a skill game facility in Mexico. The defendant paid plaintiff $100,000 on Feb. 15, 2001, but discontinued payments after the Mexican government seized the failed project in October 2001. The plaintiff sued defendant, alleging breach of contract.
Contentions
PLAINTIFF'S CONTENTIONS:
The plaintiff contended defendant agreed to pay $450,000 for his interest in the business. The defendant breached the contract by refusing to make further payments after the initial $100,000 payment in February 2001.
DEFENDANT'S CONTENTIONS:
The defendant contended it was not obligated under the agreement. Instead plaintiff should have sued its subsidiary, Juagos de Mexico, who agreed to pay the loan balance in installments under the contract.
Damages
The plaintiff sought $350,000 principal, $210,767 interest, and $1,250 costs.
Result
Judge Richard Strauss of San Diego Superior Court issued a bench decision for $350,000.
