Facts

The plaintiffs' allegations involved the birth of Logan Garcia, which occurred on Aug. 19, 2003. The plaintiffs claimed that Yvette Garcia's obstetrician/gynecologist, defendant Patrick Sutton, M.D., should have considered a cesarean section for gestational diabetes. The failure to consider a cesarean section was alleged to have led to a vaginal birth, which caused shoulder dystocia and a brachial plexus injury to Logan Garcia.

Dr. Patrick Sutton contended that Yvette Garcia did not show any signs or symptoms of diabetes and the estimated birth weight did not give rise to any indication for cesarean section. Dr. Sutton also contended he complied with the standard of care at all times and his actions/omissions did not cause or contribute to the plaintiffs' injuries to a reasonable degree of medical probability.
