Facts

Plaintiff Polly Villery, then 15 years old, suffered a severely fractured ankle when she was injured at a school construction site. As Villery was walking through the school hallway, someone opened a classroom door from the inside, causing 12-15 dry erase boards to knock her over and crush her right ankle. According to deposition testimony, a construction worker had leaned the dry erase boards against a locker, and a student moved them against the closed classroom door.

Result

Plaintiff was awarded $350,000 through mediation structured settlement.
