Facts

On April 21, 2009, plaintiff, a 26-year-old stuntwoman who has appeared in numerous movies and television shows, was driving her motorcycle on the Santa Ana freeway, when she was hit by a car that was changing lanes.

Contentions

PLAINTIFF'S CONTENTIONS:
Plaintiff contended that she suffered personal injuries and a loss of earnings. In addition, plaintiff asserted a loss of earning capacity due to her inability to do certain stunts following the injury.

DEFENDANT'S CONTENTIONS:
Defendant claimed that plaintiff's loss of earning and earning capacity claims were inflated.

Injuries

Plaintiff suffered a scaphoid fracture of the right wrist. She underwent surgery to repair the fracture on April 24, 2009, and she underwent a second surgery on July 28, 2009 for screw removal. She did well post-operatively, although with some decrease in active wrist flexion and extension compared to preoperative levels. Her physician indicated she had a 10 percent upper extremity impairment rating, which, in turn, translated into a 6 percent whole person impairment rating.

Result

The case settled for $100,000.
