Facts
In 1995, plaintiff Shirley Doan and defendant Pete Pham were in a romantic relationship when Doan moved to Pham's residence in Conde Court in Fremont. Pham sold the residence in 1999. In 2004, the couple contracted to purchase a new home on Codiroli Way in Livermore. In 2007, Doan moved out of the home and sued Pham for breach of express contract, breach of implied contract, promissory estoppel, and constructive trust. She claimed that as a result of his breach of their agreement, Doan was prevented from performing her obligation under the agreement.
Contentions
PLAINTIFF'S CONTENTIONS:
Doan claimed that in 1998, she and Pham agreed to live together essentially as husband and wife, sharing assets, income, and expenses.
DEFENDANT'S CONTENTIONS:
Pham claimed the couple did not agree to live as husband and wife.
Damages
Doan claimed emotional distress, unspecified damages, costs, and attorney fees.
Result
The jury returned a verdict for Pham.
